A witness statement is a document that presents a record of relevant evidence that is submitted by someone who has been spoken to, which is signed by that person to confirm that the contents of the statement are true.

It is very important that the statement is drafted in such a way that presents a logical flow with regard to the issues under review, as the witness statement influences the way others perceive you and your case.

 

 

 

In civil proceedings although the witness statements and particulars of claim [ET1] are separate documents, the content of the ET1 and witness statement of the claimant can be very similar.

The witness statement will be drafted with significant linkage to the Respondents ET3 and documents that have been disclosed. Therefore reference to key and relevant documents in the trial bundle will be applied to the witness statement.

A witness statement is evidence that may be used to rebut arguments where they can be dealt with in a relevant manner.

The ability to respond to the ET1 or ET3 and make reference to the documents in the bundle means that the legal representative may use the witness statement to tie the case together in a more cogent way than it is presented in the ET1.

Repetition will be inevitable, but the witness statement will present a more purposeful and updated document.
